  16.    SEC. 100001. SHORT TITLE.

  20.    This title may be cited as the "Drunk Driving Child Protection
  21.    1994".
  22.

  25.    SEC. 100002. STATE LAWS APPLIED IN AREAS OF FEDERAL
  26.    
  27.    
  28.    
  29.    Section 13(b) of title 18, United States Code, is amended-
  30.    
  31.    
  32.    
  33.    (1) by striking "For purposes" and inserting "(1) Subject to paragraph
  34.    (2) and for purposes"; and
  35.    
  36.    
  37.    
  38.    (2) by adding at the end the following new paragraph:
  39.    
  40.    
  41.    
  42.    "(2)(A) In addition to any term of imprisonment provided for operating
  43.    a motor vehicle under the influence of a drug or alcohol imposed under
  44.    the law of a State, territory, possession, or district, the punishment
  45.    for such an offense under this section shall include an additional
  46.    term of imprisonment of not more than 1 year, or if serious bodily
  47.    injury of a minor is caused, not more than 5 years, or if death of a
  48.    minor is caused, not more than 10 years, and an additional fine of not
  49.    more than $ 1,000, or both, if-
  50.    
  51.    
  52.    
  53.    "(i) a minor (other than the offender) was present in the motor
  54.    vehicle when the offense was committed; and
  55.    
  56.    
  57.    
  58.    "(ii) the law of the State, territory, possession, or district in
  59.    which the offense occurred does not provide an additional term of
  60.    imprisonment under the circumstances described in clause (i).
  61.    
  62.    
  63.    
  64.    "(B) For the purposes of subparagraph (A), the term 'minor' means a
  65.    person less than 18 years of age.".

  69.    SEC. 100003. DRIVING WHILE INTOXICATED PROSECUTION PROGRAM.

  73.    Section 501(b) of the Omnibus Crime Control and Safe Streets Act of
  74.    1968 (42 U.S.C. 3751) is amended-
  75.    
  76.    
  77.    
  78.    (1) by striking "and" at the end of paragraph (20);
  79.    
  80.    
  81.    
  82.    (2) by striking the period at the end of paragraph (21) and inserting
  83.    "; and"; and
  84.    
  85.    
  86.    
  87.    (3) by adding at the end the following new paragraph:
  88.    
  89.    
  90.    
  91.    "(22) programs for the prosecution of driving while intoxicated
  92.    charges and the enforcement of other laws relating to alcohol use and
  93.    the operation of motor vehicles.".
